                <description>Algemene leveringsvoorwaarden.

1 Algemeen
1.1. Deze Koopvoorwaarden zijn van toepassing op aanbiedingen, bestellingen en overeenkomsten van Racehistory and aviation. Door het totstandkomen van een overeenkomst tussen de klant en Racehistory and aviation volgens de procedure zoals deze is omschreven in deze Koopvoorwaarden, accepteert de klant deze voorwaarden.
1.2. Alle rechten en aanspraken, zoals in deze Koopvoorwaarden, en in eventuele nadere overeenkomsten die ten behoeve van Racehistory and aviation worden bedongen, worden evenzeer bedongen ten behoeve van door Racehistory and aviationin geschakelde tussenpersonen en andere derden.
1.3. Afwijkingen van deze Koopvoorwaarden zijn alleen geldig als deze schriftelijk met Racehistory and aviation zijn overeengekomen.
1.4. Racehistory and aviation heeft het recht deze Koopvoorwaarden en de inhoud van de Racehistory and aviation website te wijzigen.
2 Aanbiedingen en overeenkomsten
2.1. Alle aanbiedingen gedaan op de website van Racehistory and aviation zijn vrijblijvend, ook indien deze een termijn van aanvaarding bevatten. Racehistory and aviation behoudt zich het recht voor om aanbiedingen in te trekken. Alle aanbiedingen gelden op basis van beschikbaarheid. Prijswijzigingen zijn voorbehouden.
2.2. Een overeenkomst tussen Racehistory and aviation en de klant komt tot stand nadat de klant: een bestelling heeft
geplaatst, middels het volledig invullen van het bestelformulier op de website van Racehistory and aviation het door de klant vervolgens op &#039;Bestel&#039; icoon klikken op de website van Racehistory and aviation het hierna door de klant bevestigen dat de door de klant verstrekte gegevens juist zijn en het doen verwerken van de bestelling van de klant, door op de website van Racehistory and aviationop de &#039;Bestel&#039; icoon te klikken, hierop van Racehistory and aviation op het e-mailadres van de klant een bevestiging heeft ontvangen dat Racehistory and aviation de bestelling van de klant heeft ontvangen (de ontvangstbevestiging).2.3. De administratie van Racehistory and aviation geldt, behoudens tegenbewijs, als bewijs van de door de klant aan Racehistory and aviation verstrekte opdrachten en gedane betalingen en van door Racehistory and aviation verrichte leveringen. Racehistory and aviation erkent dat elektronische communicatie als bewijs kan dienen. Door het accepteren van de Koopvoorwaarden erkent de klant dit eveneens.

3 Prijzen/tarieven en betaling
3.1. Alle prijzen voor de aangeboden zaken zijn in EURO&#039;s en inclusief omzetbelasting (btw). Voor elke bestelling in Nederland wordt een bijdrage in de handling- en verzendkosten van € 8,00 per bestelling in rekening gebracht, tenzij anders vermeld of schriftelijk overeengekomen. Voor Europa 1 zijn de verzendkosten 15,00 Euro.
3.2 Alle facturen zullen door de klant worden betaald, zonder korting of compensatie binnen veertien (14) dagen na factuurdatum, tenzij schriftelijk anders overeengekomen
3.3. Bij niet nakoming door de klant van hetgeen omtrent betaling is overeengekomen, is Racehistory and aviation gerechtigd de overeenkomst met onmiddellijke ingang buitengerechtelijk te ontbinden of haar verplichtingen op te schorten, alsmede gerechtigd de klant zonder opgave van redenen de toegang tot het systeem van Racehistory and aviation te weigeren.4 Levering/verzendingstermijnen

4.1. Leveringen vinden alleen plaats binnen Europa of tenzij op de website van Racehistory and aviationanders is aangegeven of tenzij met Racehistory and aviation anders is overeengekomen.4.2. De verzendtijd bedraagt normaal gesproken maximaal drie (3) werkdagen ná ontvangst van de bestelling, tenzij op de website van Racehistory and aviation anders is aangegeven. De verzendtijden gelden als indicatie en niet als fatale termijn.

4.3. De verzendtermijn van het product bedraagt maximaal dertig (30) dagen.

4.4. Wanneer de overeengekomen verzendtermijn, om welke reden dan ook, door Racehistory and aviationoverschreden wordt, zal Racehistory and aviation de klant hiervan onmiddellijk schriftelijk (via brief of e-mail) in kennis stellen. In dat geval heeft de klant de bevoegdheid om de overeenkomst met Racehistory and aviation te ontbinden, door dit schriftelijk (via brief of e-mail) aan Racehistory and aviation te melden.

4.5. Eventuele reeds door de klant gedane betalingen worden zo spoedig mogelijk, maar in ieder geval binnen veertien (14) werkdagen nadat Racehistory and aviation het in artikel 4.4 genoemde verzoek tot ontbinding van de overeenkomst heeft ontvangen, op de bank- of girorekening van de klant teruggestort.

4.6. Racehistory and aviation behoudt zich het recht voor om tot deelleveringen aan de klant over te gaan, zodat een bestelling in twee of meerdere zendingen wordt verzonden.

5 Overmacht en/of bijzondere omstandigheden

5.1. Racehistory and aviation is niet gehouden tot het nakomen van enige verplichting jegens de klant indien zij daartoe verhinderd is als gevolg van een omstandigheid, die niet is te wijten aan haar schuld, noch krachtens wet, rechtshandeling of in het verkeer geldende opvattingen voor haar rekening komt.5.2. Omstandigheden in de zin van artikel 5.1 zijn ondermeer een bedrijfsstoring, een storing in de energie- of materiaalaanvoer, transportvertraging, een staking en het niet of niet meer tijdig leveren door leveranciers.

6 Risico

6.1. Het risico tijdens het transport van het door de klant bestelde product is voor racehistory and aviation. Op het moment van aflevering van het product, of het moment dat redelijkerwijze als aflevering beschouwd kan worden, gaat het risico van het product op de klant over, behoudens de aansprakelijkheden die wettelijk niet door Racehistory and aviation kunnen worden uitgesloten.7 Intellectuele en industriële eigendomsrechten

7.1. De klant dient alle intellectuele en industriële eigendomsrechten die rusten op de door Racehistory and aviation geleverde zaken geheel en onvoorwaardelijk te respecteren.7.2. Racehistory and aviation garandeert niet dat de aan de klant geleverde zaken geen inbreuk maken op enig intellectueel en/of industrieel eigendomsrecht van derden en aanvaardt geen enkele aansprakelijkheid in geval van enige aanspraak van derden gebaseerd op de stelling dat met een door Racehistory and aviation geleverde zaak inbreuk wordt gemaakt op enig recht van een derde.

8 Bestellingen/communicatie

8.1. Racehistory and aviation is op geen enkele manier aansprakelijk voor misverstanden, beschadigingen, vertragingen of niet duidelijk overkomen van bestellingen en mededelingen ten gevolge van het gebruik van internet of enig ander communicatiemiddel in het verkeer tussen de klant en Racehistory and aviation dan wel tussen Racehistory and aviationen derden, voor zover betrekking hebbend op de relatie tussen de klant en Classicmodelcars9 Afkoelingsperiode

9.1. Nadat de klant het door hem/haar bestelde product heeft ontvangen, heeft de klant de bevoegdheid om binnen zeven (7) werkdagen na de ontvangst van dit product, de onderliggende overeenkomst met Racehistory and aviation te ontbinden. De klant hoeft hiervoor geen reden op te geven.9.2. Indien de klant de overeenkomst ingevolge artikel 9.1 van deze voorwaarden wenst te ontbinden, dient de klant dit schriftelijk (via e-mail, brief ) aan Racehistory and aviation te melden. De klant dient het product - na overleg met Racehistory and aviation- te sturen naar een door Racehistory and aviation vastgesteld retouradres. De klant dient in dit geval zelf de kosten van en het risico voor het verzenden te dragen.

9.3. Indien de klant reeds enige betalingen heeft verricht op het moment dat de klant de overeenkomst met Racehistory and aviation ingevolge artikel 9.1. en 9.2 van deze Koopvoorwaarden heeft herroepen, zal Racehistory and aviationdeze betalingen binnen veertien (14) werkdagen nadat Racehistory and aviationhet door de klant geretourneerde product heeft ontvangen, aan de klant terugbetalen.

9.4. Racehistory and aviation behoudt het recht om geretourneerde producten te weigeren of om slechts een gedeelte van het reeds betaalde bedrag te crediteren, wanneer het vermoeden bestaat dat het product reeds is geopend, gebruikt of door de schuld van de klant (anders dan die van Racehistory and aviation of de leverancier van het product) is beschadigd.

9.5. Indien een product wordt geretourneerd dat naar het oordeel van Racehistory and aviation schade heeft opgelopen die aan een handeling of nalatigheid van de klant te wijten is of anderszins voor risico van de klant komt, zal Racehistory and aviation de klant hiervan schriftelijk ( brief of e-mail) in kennis stellen. Racehistory and aviation heeft het recht om de waardevermindering van het product als gevolg van deze schade van het aan de klant terug te betalen bedrag in te houden.

10 Garanties

10.1. Op de door Racehistory and aviation geleverde producten bestaat een garantie. Dit is de garantie zoals die door de fabrikant op haar producten wordt vastgesteld. Deze garantie laat de rechten van de klant die hiertoe voortvloeien uit de wet, onverlet.11 Klachten

11.1. Alle klachten in verband met de levering, kwaliteit, hoedanigheid van het product of iedere andere klacht, zullen door Racehistory and aviation serieus in behandeling worden genomen.11.2. De klant dient een klacht kenbaar te maken bij de afdeling Helpdesk van Racehistory and aviation(de gegevens van deze afdeling staan elders vermeld in deze Koopvoorwaarden).

11.3. Racehistory and aviation zal binnen tien (10) werkdagen de klacht proberen op te lossen. Racehistory and aviation zal de klant hierover schriftelijk (brief of e-mail) berichten.

12 Persoonsgegevens

12.1. Door de klant ingevoerde persoonlijke gegevens zullen worden opgenomen in een bestand. Deze gegevens zullen worden gebruikt voor de uitvoering van de bestelling van de klant. Deze gegevens zullen niet worden verstrekt aan derden.12.2. Tenzij de klant heeft aangegeven dat de klant hier geen prijs op stelt, zullen de gegevens van de klant worden opgenomen in een centraal bestand van racehistory and aviation. Deze gegevens zullen worden gebruikt om de klant volledig up-to-date te houden wat betreft de zaken en diensten van racehistory and aviation. De verwerking van de gegevens van de klant zal geschieden in overeenstemming met de toepasselijke wet- en regelgeving.

12.3. Eventuele creditcardgegevens van de klant - zoals kaartnummer en vervaldatum - zullen door Racehistory and aviation in geen enkel bestand worden opgeslagen.

12.4. De klant kan desgewenst inzage verkrijgen in de gegevens die door Racehistory and aviation over de persoon van de klant worden opgenomen in het bestand van racehistory and aviation. De klant is gerechtigd wijziging van de gegevens te verlangen, indien deze gegevens niet correct zijn.

14 Diversen
14.1. Indien de klant aan Racehistory and aviation schriftelijk opgave doet van een adres, is Racehistory and aviationgerechtigd alle bestellingen te verzenden aan het desbetreffende adres, totdat de klant Racehistory and aviation een nieuw adres heeft doorgegeven.14.2. Racehistory and aviationis bevoegd bij de uitvoering van de bestelling(en) van de klant gebruik te maken van derden.

15 Toepasselijke recht en geschillenregeling

15.1. Op alle aanbiedingen, bestellingen en overeenkomsten van Racehistory and aviationis het Nederlands recht van toepassing.Geschillen tussen Racehistory and aviationen de klant zullen worden voorgelegd aan de bevoegde Nederlandse Rechter te Assen</description>
