Terms and conditions
1 General
1.1. Buy these conditions apply to offers, orders and agreements of Racehistory and Aviation. By the completion of an agreement between the customer and Classic model cars according to the procedure as described in these Terms of Sale, the customer accepts these conditions.
1.2. All rights and claims contained in this Purchase Terms, and any further agreements for Racehistory and Aviation are made, are also stipulated for by Classic Model Cars intermediaries and other third parties.
1.3. Deviations from these Purchase Terms shall be valid only if a written agreed Racehistory and Aviation.
1.4. Racehistory and Aviation has the right to buy these Terms and the contents of the Racehistory and Aviation website change.
2 Offers and Contracts
2.1. All offers made on the website of Racehistory and Aviation remain free, even if a period of acceptance. Racehistory and Aviations reserves the right to submit offers to withdraw. All offers are subject to availability. Price changes are reserved.
2.2. An agreement between Racehistory and Aviation and the customer is established after the client has an order

2.3. 3 prices / rates and payment
3.1. All prices for items offered are in Euros and include tax (VAT). For each order in the Netherlands is a contribution in the handling and shipping of € 6.75 per order, unless otherwise stated or agreed in writing. For Europe, a surcharge of € 7.90
3.2 All invoices will be paid by the customer, without discount or compensation within fourteen (14) days after the invoice date, unless otherwise agreed in writing
3.3. For failure by the customer agreed payment is agreed, Racehistory and Aviation terminate the agreement with immediate effect without judicial intervention or its obligations to suspend, and also entitled the customer without giving any reason access to the system of Racehistory and Aviation to refuse.
4 Delivery / shipping times
4.1. Deliveries only take place within the Netherlands or unless the website of Classic Model Cars stated otherwise or unless otherwise agreed Classic Model Cars.
4.2. The shipping time is at most ten (10) days after receiving the order, unless the website of Classic Model Cars otherwise. The shipping times are indicative and not a deadline.
4.3. The term of shipping the product will be thirty (30) days.
4.4. If the agreed delivery period, for whatever reason, is exceeded by Classic Model Cars, Model Cars Classic will the customer immediately in writing (via letter or email) to notify. 5 Force Majeure and / or special circumstances
5.1. Classic Model Cars is not obliged to perform any obligation to the customer if they are prevented due to a circumstance that can not be blamed, nor under the law, legal act or generally accepted for its account.
5.2. Circumstances within the meaning of Article 5.1 include an operational failure, a failure in the energy and material supply, transport delays, strikes and no further timely delivery by suppliers.
6 Risk
6.1. The risk during transport of the products ordered by the customer for Classic Model Cars. At the time of delivery of the product, or when reasonably be regarded as delivery, the risk of the product to the customer, subject to the liabilities legally Classic Model Cars can not be excluded.
7 Intellectual and industrial property rights
7.1. The client must respect all intellectual and industrial property rights in the Classic Model Cars delivered fully and unconditionally.
7.2. Classic Model Cars does not warrant that the delivered items do not infringe any intellectual or industrial property rights of third parties and accepts no liability for any claims by third parties based on the proposition that a Classic Model Cars, is in violation made any right of third.
8 Orders / communication
8.1. Classic Model Cars is not responsible for any misunderstandings, damage, delays or any obscurity concerning orders and communications of the Internet or any other means of communication between the customer and Classic Model Cars or between Classic Model Cars and others as they relate to the relationship between the customer and Classic Model Cars
9 Cooling off period
9.1. After the customer his / her product is received, the client has the authority within seven (7) days after receiving the product, the agreement with Classic Model Cars cancel. The customer is no reason to give up.

9.3. If the customer has already made payments at the time the customer agreement with article 9.1 Classic Model Cars. and 9.2 of this Purchase Terms, revoked, will Classic Model Cars such payments within fourteen (14) days after Classic Model Cars by the customer returned product has received to reimburse the customer.
9.4. Classic Model Cars reserves the right to return products or to take only a portion of the amount already paid by credit where it is suspected that the product has been opened, used or fault of the customer (unlike those of Classic Model Cars or supplier of the product) is damaged.
9.5. If a product is returned in the opinion of the Classic Model Cars damaged by an act or omission by the customer due or is otherwise at risk of the customer, will Classic Model Cars the customer in writing (letter or e-mail) set. 10 Guarantees

11 Complaints
11.1. All complaints relating to the supply, quality, quality of the product or any other complaint by Classic Model Cars will be dealt with seriously.

12 Personal
12.1. Through personal customer information will be included in a file. This information will be used to implement the customer order. This information will not be provided to third parties.

This information will be used to the customer up-to-date regarding the business and services of Classic Model Cars. The processing of customer data will be in accordance with the applicable laws and regulations.
12.3. Any credit card information of customers - such as card number and expiration date - will not by Classic Model Cars in single file.
12.4. The customer can optionally ask for access to the data model by Classic Cars on the person of the customer are included in the file of Classic Model Cars. The customer is entitled to require modification of the data, if data is not correct.

14 Miscellaneous
14.1. When the customer Classic Model Cars in writing of an address, Classic Model Cars all orders shipping to this address until the customer Classic Model Cars a new address given.

15 Applicable law and dispute settlement
15.1. All offers, orders and agreements of Classic Model Cars to Dutch law.
